Can I sell my rental house with a tenant still living in it in NC?

Yes, you can sell a North Carolina rental with a tenant living in it. A sale does not end the lease, so the buyer generally takes the house subject to it, and within 30 days you must either transfer the tenant’s security deposit to the buyer and tell the tenant, or refund it (N.C.G.S. 42-54, checked October 10, 2026).

What happens to the lease when you sell

The lease goes with the house. NC REALTORS legal counsel explains that a residential lease generally stays in effect after a sale unless the lease itself gives a right to end it, the landlord and tenant agree to end it, or the tenant materially breaches it (NC REALTORS, What happens to a lease when property is sold?, November 8, 2016, page updated April 8, 2025, read October 10, 2026).

For a typical one-year lease, the buyer is bound even though the lease was never recorded. Only a lease of more than three years must be recorded at the register of deeds to be good against a buyer (N.C.G.S. 47-18(a), checked October 10, 2026), and a shorter lease binds a buyer who knows about it or where the tenant is living in the house (NC REALTORS, read October 10, 2026).

How much time you have, depending on the lease

Type of tenancyWhat a sale changesNotice to end it
Fixed-term lease (for example, 12 months)Nothing. It runs to its end date unless the lease has an early-termination clause or the tenant agrees.Set by the lease
Month-to-monthNothing by itself. Either side can end it with notice. At least 7 days before the end of a rental period, unless the lease requires more (N.C.G.S. 42-14)
Year-to-yearNothing by itself. One month or more before the end of the current year of the tenancy (N.C.G.S. 42-14)
Vacation rental agreementDifferent rules apply. See the beach town note below.N.C.G.S. 42A-19

Check your lease for any longer notice period, a clause about sale, and what it says about entry and showings. Ending a tenancy does not let anyone change the locks or remove belongings: a residential tenant may be removed only through the court procedures in Chapter 42 (N.C.G.S. 42-25.6, checked October 10, 2026). If a tenant will not leave, that means the court process in our answer on how long an eviction takes in NC.

What to do first

  1. Pull the paperwork. The signed lease, any renewals, the rent ledger, and the record of the security deposit. A buyer under the standard NC contract has the right to review copies of the leases during due diligence (NC REALTORS, read October 10, 2026).
  2. Confirm where the deposit is. North Carolina requires a residential landlord to hold deposits in a trust account at a licensed and insured bank, or to post a bond, and to tell the tenant where (N.C.G.S. 42-50, checked October 10, 2026). The buyer’s attorney will ask.
  3. Talk to the tenant early and in writing. Tell them the house is for sale, that their lease continues, and how showings will be scheduled under the lease.
  4. Plan the deposit transfer. Within 30 days after your interest ends, transfer what remains after lawful deductions to the buyer and notify the tenant by mail of the buyer’s name and address, or refund it to the tenant (N.C.G.S. 42-54). Rents are usually prorated through closing under the standard contract (NC REALTORS, read October 10, 2026).
  5. Call a CPA before you sign. Depreciation you took on a rental lowers your basis, which raises the taxable gain when you sell (IRS Publication 527 (2025), checked October 10, 2026).

Your options

Listing versus a cash offer: an honest comparison

If the tenant pays on time, the house shows reasonably well, and you have a few months, listing usually nets more. You can list to investors with the tenant in place, or wait for the lease to end and list to owner-occupant buyers. A good tenant is an asset, not a problem.

A cash sale tends to make more sense when the tenant has stopped paying, when the house needs work you cannot do with someone living there, when you live far away, or when you simply want to be done on a date you choose. It trades some money for speed, certainty and no repairs or turnover. Our cash offer vs. listing framework lays out the math, and our page for landlords explains how an occupied sale works with us.

Beach town note: vacation rentals follow different rules

If the house is a weekly or seasonal vacation rental, such as many in Carolina Beach, Kure Beach, Oak Island, Topsail Beach or North Topsail Beach, the Vacation Rental Act applies instead of the usual lease rules. A buyer takes title subject to vacation rental agreements that end within 180 days after the deed is recorded. Before signing a sale contract, the seller must disclose the booked periods; within 10 days after the transfer, the seller must give the buyer each guest’s name, address and agreement; and within 30 days, advance rent must be transferred to the new owner or, where the booking will not be honored, refunded to the guest (N.C.G.S. 42A-19, checked October 10, 2026). Your rental management company should be part of the plan from the start.

Questions people ask

Does selling my house end my tenant’s lease in North Carolina?

No. A residential lease generally stays in effect after a sale, and the buyer takes the property subject to it, unless the lease gives a right to end it, the landlord and tenant agree to end it, or the tenant materially breaches it (NC REALTORS legal Q and A, November 8, 2016). Only leases longer than three years must be recorded to bind a buyer (N.C.G.S. 47-18).

What happens to my tenant’s security deposit when I sell?

Within 30 days after your interest in the property ends, North Carolina law requires you to either transfer the remaining deposit, after lawful deductions, to the new owner and notify the tenant by mail of the new owner’s name and address, or return it to the tenant (N.C.G.S. 42-54). Doing either one ends your responsibility for that money.

Can I make a month-to-month tenant move out so I can sell?

You can end a month-to-month tenancy with notice at least 7 days before the end of a rental period, unless your lease requires more (N.C.G.S. 42-14). If the tenant does not leave, North Carolina allows removal only through the court process, so a landlord cannot change the locks or remove belongings to force a move (N.C.G.S. 42-25.6).

Do I have to tell a buyer about my tenant?

Yes, in practice. The buyer will be bound by the lease, and under the standard North Carolina purchase contract a buyer of rental property has the right to review copies of the leases during due diligence (NC REALTORS legal Q and A, November 8, 2016). Sharing the lease, rent ledger and deposit record early avoids surprises at closing.
